1. Introduction

Welcome to PicSpot, a service provided by Douglas & Reynholm Hungary Kft. ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of PicSpot's web-based photo gallery service (the "Service"). By accessing or using PicSpot in any manner, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Service.

2. Eligibility and User Responsibilities

You must be at least 13 years old (or the minimum legal age in your country) to use PicSpot. By using the Service, you represent that you meet the minimum age requirement and have the legal capacity to enter into a binding contract.

You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account. You agree to notify us immediately at [email protected] if you suspect unauthorized access.

3. Service Description

PicSpot allows users to:

• Authenticate via Google account login;
• Connect a specific Google Drive folder;
• Create and share online photo galleries using files from that folder;
• Use customization tools to manage gallery appearance, branding, and access control.

We do not store, download, or permanently copy any of your Google Drive content. Images remain in your Drive, and we access only the files you authorize. Some image content may be cached temporarily by Cloudflare to improve performance.

4. Privacy and Data Use

Our use of personal data is governed by our Privacy Policy. By using our Service, you consent to the collection and use of your information as outlined therein.

• We only store your Google account name and email;
• We do not store or copy your images;
• Caching is temporary and managed by Cloudflare;
• You may revoke permissions at any time via Google settings.

5. Acceptable Use

You agree not to use PicSpot to:

• Upload, share, or display content that is hateful, discriminatory, pornographic, or sexually explicit;
• Violate any laws or third-party rights;
• Upload, display, or distribute unlawful or abusive content;
• Attempt unauthorized access to servers or systems;
• Disrupt the functionality or security of the Service.

We reserve the right to suspend or terminate any account that violates these provisions.

6. Intellectual Property

All intellectual property on PicSpot (excluding user-submitted content) is owned by Douglas & Reynholm Hungary Kft. or its licensors. You may not reproduce, redistribute, or commercially exploit any part of the Service without our written permission.

7. License and Ownership of Content

You retain ownership of your uploaded content. You grant us a limited, non-exclusive, revocable license to access and temporarily display this content solely for the purpose of rendering your gallery.

No files are copied outside of temporary caching when applicable.

8. Third-Party Services

PicSpot uses the following services:

• Google (authentication and file access)
• Cloudflare (CDN, hosting, database)
• Ahrefs (analytics)
• Crisp (customer support chat)
• Rackforest (email infrastructure)

9. Service Availability

We aim for high uptime but cannot guarantee uninterrupted access. Downtime may occur due to maintenance or external issues.

Dependency on Google API:

PicSpot depends on Google's Drive API. If access is restricted or revoked, our services may be interrupted. We will attempt to resume service quickly, but this remains a known operational risk.

10. Payment and Subscription

PicSpot offers two packages:

• Free Package: Access to core features
• Pro Package: Enhanced galleries, analytics, custom branding

The Pro plan includes a 7-day free trial. You register with a credit card, and unless canceled within the trial, charges apply at the end of 7 days. Cancel anytime to avoid charges.

11. Refund Policy

We're committed to fairness. If you're not satisfied, contact us. We're generous with refunds and will find a solution that works for both of us.

12. Termination

You may terminate your account by disconnecting Google Drive. We may suspend or terminate accounts for violations. After termination, data is deleted and access is revoked.

13. Disclaimers

The Service is provided “as is.” We do not guarantee uninterrupted access or suitability for your intended purpose. Use at your own risk.

14. Limitation of Liability

We are not liable for indirect or consequential damages. Total liability is limited to what you paid us in the past 12 months, if applicable.

15. Indemnification

You agree to indemnify and hold us harmless from any claims or liabilities arising from your use of the Service or content you submit.

16. Governing Law

These Terms are governed by the laws of Hungary. Disputes will be resolved in the competent courts of Budapest, Hungary.

17. Amendments

We may update these Terms. Any material changes will be communicated on this site. Continued use after changes implies agreement.
